Agreement to Terms
By downloading, installing, or using FallDetect ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Important Disclaimer
Warning: FallDetect is designed to assist in detecting falls and alerting emergency contacts, but it is NOT a substitute for professional medical monitoring, emergency services, or personal supervision. The App may not detect all falls or may occasionally produce false alerts.
By using this App, you acknowledge and agree that:
- The App should not be relied upon as the sole means of fall detection or emergency response
- You should always have alternative emergency plans in place
- The App's effectiveness depends on various factors including device placement, movement patterns, and environmental conditions
- In case of a medical emergency, always contact emergency services (911 or local equivalent) directly
Description of Service
FallDetect provides the following features:
- Fall detection using your device's accelerometer sensors
- Automatic countdown timer after fall detection
- Emergency SMS alerts to pre-configured contacts
- GPS location sharing in emergency messages
- Visual and audio alerts (screen flash and alarm)
- Manual SOS button for immediate alerts
User Responsibilities
As a user of FallDetect, you are responsible for:
- Providing accurate emergency contact information
- Ensuring your device has sufficient battery and mobile signal
- Granting necessary permissions for the App to function
- Testing the App to ensure it works correctly on your device
- Informing your emergency contacts that they may receive alerts from the App
- Keeping the App updated to the latest version
Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" without warranties of any kind
- We do not guarantee that the App will detect all falls
- We are not liable for any damages resulting from the use or inability to use the App
- We are not responsible for SMS delivery failures due to network issues
- We are not liable for any consequences arising from false alerts or missed detections
You agree to use the App at your own risk and understand that no fall detection system is 100% reliable.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Misuse the SOS feature to send false emergency alerts
- Attempt to reverse engineer or modify the App
- Use the App in a way that could harm others
Intellectual Property
The App and its original content, features, and functionality are owned by the developer and are protected by international copyright, trademark, and other intellectual property laws.
SMS and Data Charges
The App sends SMS messages to your emergency contacts when a fall is detected or when you use the SOS feature. Standard SMS rates from your mobile carrier may apply. You are responsible for any charges incurred.
Modifications to Service
We reserve the right to modify or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
Changes to Terms
We may revise these Terms of Service at any time. By continuing to use the App after any changes, you agree to be bound by the revised terms. Please review these terms periodically.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
