Terms of Service

These Terms of Service ("Terms") govern your use of the Tapr mobile application ("Tapr", "the app"). By installing or using Tapr you agree to be bound by these Terms. If you do not agree, do not install or use the app.

1. What Tapr is, and what it isn't

Tapr is a personal habit-tracking lifestyle tool. It helps you log how often you smoke, set a personal weekly schedule that gradually reduces your daily count, and track the money you save in the process.

Tapr is not:

• A medical device;
• A treatment for nicotine addiction or any other health condition;
• A substitute for medical advice, smoking-cessation therapy, or pharmacotherapy;
• An emergency service of any kind.

If you are concerned about your smoking, withdrawal symptoms, anxiety or depression while reducing your nicotine intake, please consult a healthcare professional. The clinical PDF report that the Pro version can generate is intended only as a discussion aid for a healthcare provider — it is not a clinical assessment.

2. Eligibility

You must be at least 18 years of age to use Tapr. By installing the app you confirm that you meet this requirement.

3. The free version

The free version of Tapr provides single-tap cigarette logging, a personal taper plan, daily and weekly statistics, money-saved tracking, daily reminders, weekly summaries, the craving timer, the on-device trigger pie chart, and the basic plan-restart and goal-edit flows. The free version works fully offline and contains no advertising and no analytics tracking.

4. Pro lifetime upgrade

Pro is a one-time in-app purchase processed by Google Play. Once unlocked it stays unlocked on every device signed into the same Google account that made the purchase, with no recurring charges.

• Price: €19.99 (or local equivalent set by Google Play). Tax may be added in your jurisdiction.
• Billing: handled entirely by Google Play. We never see your card details.
• What it unlocks:
  • Cloud Sync between devices, end-to-end encrypted;
  • AI Insights — a once-a-day server-generated short paragraph in your language summarising your patterns;
  • Risk Zones — geofence-based alerts at places where you typically smoke;
  • Custom Plan Editor — adjust the taper length (6–24 weeks) and override individual weeks for plateaus;
  • Clinical PDF Export — a one-page report you can share with your doctor;
  • Any future Pro-tier features added at no additional cost.
• Refunds: handled by Google Play under its standard refund policy. To request a refund, open the Play Store, go to Account → Order history, find the Tapr Pro purchase and tap "Request a refund". Outside the standard window, refunds are at Google's sole discretion. We are not able to issue refunds outside Google Play.
• Refund consequence: if your refund is granted, Google Play notifies our server through Real-Time Developer Notifications and Tapr automatically downgrades back to the free tier within minutes. Your local cigarette log, plan and statistics are preserved on your device.

5. No accounts. Cloud Sync identifier.

Tapr does not have user accounts. There is no email address to register, no password to remember. The free version stores all data locally and requires nothing.

The Pro Cloud Sync feature uses your Google Play purchase token as the only identifier addressing your encrypted data on our server. The encryption key for your synced data is derived from this token on your device — we never see the key, and we cannot decrypt your data.

You can disable Cloud Sync at any time from More → Cloud Sync. You can request deletion of all server-side encrypted blobs and any AI-Insights aggregate uploads by emailing fenixjzdev@gmail.com — see the Privacy Policy for what we may need to verify ownership of the data.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of Tapr, except where local law expressly permits;
• Bypass Google Play Billing to obtain Pro features without payment;
• Submit forged purchase tokens or fake telemetry to our server;
• Use the app for any unlawful purpose.

7. Intellectual property

Tapr, its logo, the "Tapr" wordmark and the app's design and source code are owned by Zoran Gojković and are protected by copyright and other intellectual property laws. The license granted to you under these Terms is a non-exclusive, non-transferable, revocable license to use the app for your personal non-commercial use only.

8. Disclaimer of warranties

Tapr is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The app will be uninterrupted, timely, secure, or error-free;
• The taper plan suggested by the app will help you achieve any specific reduction in your smoking;
• The AI Insights feature will produce accurate, useful or actionable insights;
• The clinical PDF report will be sufficient or appropriate for any medical decision;
• Risk Zones will detect every arrival at a configured location, particularly in low-GPS-coverage environments such as indoors, basements, or moving vehicles;
• The app is suitable for your specific medical or psychological situation.

You use Tapr at your own risk and you take responsibility for your own health decisions.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Zoran Gojković, his affiliates, suppliers or agents be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of, or inability to access or use, the app;
• Any decisions you take regarding your smoking, your health, or your finances based on the app's outputs;
• Any unauthorised access, use or alteration of your data;
• Any third-party content, services, or products integrated with the app, including OpenAI and Google Play.

Our total cumulative liability to you for any claim arising out of or in connection with these Terms or your use of the app is limited to the amount you paid us for the app in the 12 months preceding the claim — which for free users is zero, and for Pro users is the price of the lifetime unlock.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including liability for fraud, gross negligence, or death or personal injury caused by negligence).

10. Indemnification

You agree to indemnify and hold harmless Zoran Gojković against any claim or demand, including reasonable attorneys' fees, made by a third party arising out of your breach of these Terms or your violation of any law or right of a third party.

11. Termination

You can stop using Tapr at any time by uninstalling the app. We may suspend or terminate your access if you breach these Terms or use the app in a way that, in our reasonable opinion, may cause harm to other users, to us, or to third parties. Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) shall survive.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. For material changes we will show an in-app notice the next time you open the app. Continued use after the change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Lazarevac, Serbia, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings before your local courts.
